Ana Marie Cox hasn't read Sotomayor's writing, but accuses her of "not performing at grade level"

Ana Marie Cox, in today's washingtonpost.com discussion:

Successful judges tend to be good speakers and even better writers (Scalia probably writes the most entertaining decisions of the SCOTUS, tho Roberts is also good); Sotomayor's "Latina line" makes me think she's not performing at grade level on either.

Wow, that's a pretty harsh assessment. How did Ana Marie Cox reach her conclusion that Sonia Sotomayor's writing isn't at the "grade level" of a successful judge? Not by reading Sotomayor's writing:

That said: Like 99% of the people weighing in on her nom, I haven't read her all of stuff! Or most! Or any!

What "grade level" does suggesting someone's writing is subpar without actually, you know, reading it qualify you for?  Third?

      i see ms. cox on the racheal maddow show alot and generally like her. but i must say that this is an eye opener for me. she is making a judgement that for good or ill others will look to to help shape their opinion and she has by her own admission not reviewed the judges work. i ran into something similar last week. i was listening to the hugh hewitt show on the radio and they had lawarnce o'donnel on who i see on msnbc alot. they were talking about torture and when mr. hewitt asked for an example of the U.S. prosocuting someone for waterboarding mr o'donnell could not cite a single example. well, all one has to do is a basic google search and you can find just these types of examples. i like to think that what seperates us from the conservitive side is that we like to think and see the complexities in the issues. if we let these people articulate our positions we need to hold them to a very high standard. if people like ms. cox and mr. o'donnell cannot do so we need to call them on it and get rid of them. otherwise we become the same thing we accuse (rightly) the conservitives of being.

      And? Harry Reid expressed his support for Sotomayor and then admitted that he hadn't read any of her rulings.

        The problem isn't whether they support or not Judge Sotomayor. The problem is that Ana Marie Cox accuses Judge Sotomayor of not writing "at grade level", while not even reading her work.

        But he's towing the party line so it's OK to not read or comprehend what he's about to advance on the American people.

      Reid made clear that the Senate Judiciary committee is responsible for the assessment of her writings, opinions and speeches. Reid is Majority Leader,not the chair of Judiciary. If you watched him when he said he didn't read the stuff, he said he wasn't going to read it either. Having said what he did, he didn't go on, as the dear Ana Marie did, and say something stupidly snarky. She deftly opened mouth and inserted foot.
      If you think the 2 statements are equivalent, you aren't looking at the context. Figures.
