Halperin's Page write-up of Ricci ruling ignores 5-4 split

In his write-up on The Page of the Supreme Court's ruling on Ricci v. DeStefano, Mark Halperin did not note that the Court was split, voting 5-4 in favor of reversing the U.S. 2nd Circuit Court of Appeals ruling. In addition, while mentioning that Monday is retiring Supreme Court Justice David Souter's last day, Halperin did not note that Souter agreed with the 2nd Circuit's decision in Ricci.

      I'm sure Halperin has to make sure not to include any irrelevant info so as not to make it a biased article!

      In other words, the person who Sotomayor is replacing affirmed the appeals court's decision and the case was a 5-4 decision. So almost half of the court agreed with her reasoning including the person she is replacing. What a rebuke.

          What it really is is the media once again taking the Republican stance on this issue. They are trying to make this a racial issue to perpetuate fears people in America have in the age of Obama. It really is sad.

          Yes a rebuke IS a rebuke and this SC decision is NOT a rebuke. Look the word up. When did you say good riddence to your critical thinking skills? Seems they have been gone a LOOONNNG time

        Here is a part of what the SC said today

        "The City rejected the test results solely because the higher scoring candidates were white. The question is not whether that conduct was discriminatory but whether the City had a lawful justification for its race-based action".

        Its pretty simple really.

          If it is so simple why did 4 of the nine judges disagree and say this?

          I would hold that New Haven had ample cause to believe its selection process was flawed and not justified by business necessity.

      Why is this case being viewed as a Judge Sotomayor case she was part of a panel of judges many who also refused to rehear the case? This attempt to blanket the judge with total responsibility for the reversal is just a failed, closeted attempt to prevent her confirmation. Which like it or not folks will prevail. Moreover, for those who argue that she decides her cases based on ethnicity ignore the facts that one of the plaintiffs was Hispanic. If she was into pure ethnic politics as many ignorant people argue she should have ruled for the plaintiffs. I guess to many of the intolerant members of this society the answer to "What do you call a Hispanic with a Princeton degree, editor of Yale Review, and seventeen years on the bench? To the intolerant the answer is "a Spik" but to most Americans it is a truly igalitarian society where everyone has an opportunity to succeed.
