Sowell attack against Sotomayor founders on the facts

In a July 1 column, syndicated columnist Thomas Sowell asserts of Judge Sonia Sotomayor: "Performance matters. And Judge Sotomayor's performance provides no reason for putting her on the Supreme Court." Sowell then asserts:

Although the case of the Connecticut firefighters is the latest and best-known of Judge Sotomayor's reversals by the Supreme Court, an even more revealing case was Didden v. Village of Port Chester, where the Supreme Court openly rebuked the unanimous three-judge panel that included Judge Sotomayor for "an evident denial of the most elementary forms of procedural due process."

But Sowell's attack on Sotomayor's "performance" falls flat. While it is not unusual for the Supreme Court to reverse federal appellate court decisions, the Supreme Court did not reverse Sotomayor in Didden, as Judith Schaeffer and Mike Sacks noted in a post on the Constitutional Accountability Center's Text and History blog. Indeed, the Court refused to hear the appeal of the opinion Sotomayor joined.

Sowell's quote can actually be found in a brief by several law professors urging the Supreme Court to hear an appeal of the case.

      Thomas Sowell spews his nonsense via the AJC down here... usually good for a laugh and/or a headache...

      Does anything that comes out of the Hoover Institute ever have any validity?

      Seems like maybe Sotomayor should definitely be on the bench, since 4 of them agreed with the decision that she joined. This also totally destroys the activist judge talking point, since the majority, in this case, were the "activists" now weren't they?

      How come ALL of Roberts' decisions that were reversed by the SCOTUS were never mentioned when he was being vetted and or installed into the court? Hmm...

      For what it's worth, NRO has changed Sowell's piece "to amend a factual error." It appears as though the entire paragraph(s) quoted above were omitted. Sowell is not having a good run of late. His column last week confused the national debt and the budget deficit, claimed that Obama would surrender to Iran (after they drop not one but TWO nuclear bombs on us!) and that the women of America will be living under sharia law. Dementia much?

      WOW. He got that astonishingly wrong. How do people so incompetent keep their jobs. I would be fired in a heartbeat if I did my job half that poorly

        If Limbaugh said this, would you think he was "incompetent"? It's not as if you can assume Sowell ever makes an effort to be objective, at least based on the history of work I'm familiar with. He probably got high marks for his creativity here.

      Somewhere around June 2008, Thomas Sowell had a psychotic breakdown resulting in the loss of all reason. He seems to think he is some kind of an avenging African American angel charged with bringing down the presidency of Barack Obama. His columns are strident right wing attacks rather than any kind of thoughtful conservative analysis, and he relies for back-up on people who have no credibility. I have lost all respect for this man.
