What they either don't get or don't want their audience to understand is that torture is not simply the act. It's also the motivation behind the act.
We aren't torturing our soldiers and sailors when they go through SERE training and we expose them to techniques that other countries might use to torture them. The intent of the SERE trainers makes what they do NOT torture. The intent and motivation of the interrogators in the Bush Administration was to torture. Of course, they claim they didn't torture because the Bush Admin twisted the definition of torture. The intent of the SEAL's in the piracy case was not to torture.
Reich-wingers consistently fail at making a reasonable analogy. It must be innate.
