Trace,
George W Bush couldn't even nominate who he wanted because of his right wing base. So he had to appoint ideological conservatives to placate the base. Obama needs to appoint ideological liberals to placate his base. It is what presidents do and every body knew this day would come.
Ever hear of Harriet Miers?
On October 3, 2005, Bush nominated Miers to serve as an Associate Justice of the Supreme Court. Many notable conservatives vigorously criticized her nomination, and numerous conservative groups normally considered part of Bush's political base planned to mount an organized opposition campaign.
Elections have consequences. The President can nominate anyone he wishes. Apples...meet.....Gallagher.
