        It's so obvious. What we need to do is have a special election every time a case goes to the supreme court, and let the voters decide it. Voila! No more justices out of touch with the populace!

        And nobody else could figure this out? You people, by overlooking these really simple solutions, sometimes make us geniuses second guess oursleves, and think that maybe we're just insane. Stop being so ignorant.

      Look at Mika. Joe and Mika have gone down hill and should be replaced on MSNBC in the early morning by Carlos Watson and Katessa Brewer.

      Joe and MIka should head to Fox.

        Amen to that brother. I know longer watch tv news. I was in love with MSNBC during the presidential campaign, but joe and mika broke my heart. And since my favorite coffee, Starbucks is supporting such racist right wing propangada. I have sold my starbucks stocks at a loss. Friends don't let friends drink at Starbucks.

      How confusing for me to see conservatives justifying the federal government imposing itself on municipalities. I must have misinterpreted the conservative ideology.

      Guess I better bone up on my understanding of the phrase "activist judges".

      What a shallow conclusion!!Joe continues to show his bias....a 5-4 vote shows being out of touch????Almost every vote is 5-4 and probably will continue to be so on cases where ideology influences interpretation of the law and the constitution.All this decision says is that the Supreme Court is divided along ideological lines ..same as the country!!!The country is somewhat more progressive than the court is in total ..thanks to the Bush far right appointees that joined Scalia and Thomas..

      It was a 5-4 decision. One vote could've swung it the other way. If that had happened would the conservative justices then be "out of touch?"
