      Unlike Beck, I do not believe that the American government is willfully trying to avoid bringing the perpetrators of 9/11 to justice. But if I did believe that, I probably would have voiced said concern before 2009.

      Again GlennieBoy, if this is a war then why wasn't the Geneva Convention followed? Doesn't these actions make Bush a war criminal?

      Why can't we just all be Americans and follow the Constitution? Is that so hard?

        For the Geneva convention to be observed in war, there are certain pre-requisites. Combatants MUST be part of an organized military who identify themselves as such, through uniforms or some kind of identifying badges or attire, otherwise they can be treated like those imprisoned at Gitmo. Our constitution does not apply to those imprisoned at Gitmo.

          For an overview of the Conventions, go here, and note that the 4th convention deals with 'civilians' and Common Article 3 makes no distinction:
          It requires humane treatment for all persons in enemy hands, without any adverse distinction. It specifically prohibits murder, mutilation, torture, cruel, humiliating and degrading treatment, the taking of hostages and unfair trial.

            Kanye definately got confused. What the geneva conventions say is that a country can hold prisoners of war without trial until war's end provided it is a conventional war with regular armed units. Prisoners can't be held indefinately without trial in a never-officially-ending guerilla war like the wars we're fighting right now. Since were waging a "war" against a method of violence, this is definately a case where where normal POW rules don't apply. It's just that kanye seems to think that means we can do whatever we want to the prisoners, rather than that we must try them if we are to hold them permanently.

            Murder and torture, of course, are not permitted in any situation.

          A resistance in an occupied country has the same rights as a military. This does not require an uniform or other proof.

      I think a little bit of legal history is necessary here. We are not in a state of war, no state of war has been declared since Pearl Harbor. The Bush Administration declared the detainees were not soldiers, and it took them to Gitmo to avoid both the Uniform Code of Military Justice, (UCMJ) and the U.S. Constitution, because they were not on U.S. soil. The Bush Adminstration declaration also exempted them from the Geneva Conventions, because it only applies to soldiers. This was used to deny them ANY rights, even to a lawyer before the Supreme Court, a Conservative court, weighed in and said they had to have lawyers. The Bush Administration also declared that waterboarding was not torture, even though John McCain said that it was, years ago. I am perfectly fine with trying these men in open court in the U.S. We did it with other terrorists, why not these men. It seems to me that you can't have it both ways. They are either soldiers or they are not. Since we have not declared them to be soldiers, they should be tried in a U.S. Federal Court. The Federal government has some really nice, safe, quiet Supermax prisons waiting.

      Glen Beck feel like this: since I am allowed to say anything I want on Fox News, why not say whatever I want.
      I feel sorry for the people who can't figure Beck out by now. How many stupid things can he say before people realize they are listening to a fool?
      It didn't take me long at all.
      All I had to do is see the words "Fox News".

        Good for you, but other people are slower on the uptake. I know quite a few people who haven't figured Glennie out yet. Then there are the people who really enjoy watching a train wreck, so they find him amusing. Not me, but then I don't like train wrecks or NASCAR.

        Becky is nothing more than a hustler, a carnival barker, and a grifter.
        He doesn't care about anyone other than himself.

        He has no respect for his audience. He feeds them a steady diet of lies and fantasy and laughs at their gullibility. They are simply rubes.

        He doesn't care about his country. Sure, he beats his chest and cries about his love for America, but it's all a show--it's what he gets paid to do. If Becky could make more money in another country, he'd be gone in a flash.

        As king as there are people who fear the future and embrace their own ignorance and prejudice, there will always be a Glenn Beck.

      see here is my thing......if we adhere to the radical right and treat these guys as WAR Criminals........then the World Court would have jurisdiction like the genocidal Milosevec......he was tried as a war criminal.

      Thank you, MMfA. When the KSM and the other trials are successfully concluded, I think it would be wise to re-visit some of the wild predictions and speculation that conservatives used to fear-monger. You can bet the conservatives who follow these talking heads will quickly forget the predictions and will need some reminding.
