      Shorter Troggies: Forget what we said a minute ago about teh Constitutional guarantee of citizenship being a problem. Teh Constitution like totally rocks and anyone who disagrees hates America. Except when we criticize teh Constitution.

      International law has always been used as a reference, but it is given no weight in decisions.

      If it comes down to international law or our contstitution the constitution is going to win every time. But the fact is international law and our constitution probably agree 99% of the time. Does anyone have an example of any high ranking judge, politician or political appointee arguing for any international law that is against our constitution?

      I think it was Chuck Todd who observed that the Republican Senators have resigned themselves to the reality that Kagan will probably be confirmed. They have relegated the hysterical screeching duties to the Troglodytes on Hate Radio and FOX... just to keep their Braindead Base agitated.

      "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding." - second paragraph of Article VI of the U.S. Constitution

      This is the part of the Constitution that establishes the Supremecy of the Constitution, the Laws of the United States, and Treaties made and shall be made. A treaty is not easy to get. The President has the power to make a treaty which also requires two-thirds majority in the Senate according to the second paragraph of Article II, Section 2.

      Therefore, whenever a treaty has been established that addresses any type of international law, that international law also has become part of the Supreme Law of the Land.

      Eat that Savage.

        Let me modify my last sentence.

        Therefore, whenever a treaty has been established that obligates adherence to any type of international law, that international law also has becomes part of the Supreme Law of the Land.
