Fox News ran with debunked Wash. Times column questioning legality of Elton John concert for Clinton
SUMMARY: Fox News' Megyn Kelly echoed a Washington Times column that questioned the legality of an Elton John concert for Sen. Hillary Clinton's campaign, even after the Clinton campaign posted a statement from FEC spokesman Bob Biersack saying he does not believe there is "anything unlawful about Elton John performing in a concert to raise money for a US presidential candidate." Additionally, Lis Wiehl falsely claimed that a 1981 FEC advisory opinion stated that "you couldn't volunteer any time if you're a foreign national."
During the March 27 edition of Fox News' America's Election HQ, co-host Megyn Kelly noted that "British singer Sir Elton John is trying to help his friend, [Sen.] Hillary Clinton ... by holding a one-night-only solo concert to help support her campaign." Echoing a March 27 Washington Times column, Kelly went on to ask: "The concert could rake in a lot of dough for Clinton, but is it legal?" Fox News legal analyst Lis Wiehl later asserted that "there have been a couple of rulings from the SEC saying -- the FEC [Federal Election Commission], excuse me -- saying, 'Well, you know, in '81, we said no, you couldn't volunteer any time if you're a foreign national.' But then, the Clinton campaign is hooking onto a 1987 opinion, which said, 'Yes, you could.' Now, these are only advisory opinions. So, when you ask the question, 'Is it legal?' ... we don't really know." In fact, as Media Matters for America documented, a spokesman for the FEC said earlier on March 27 that he does not believe there is "anything unlawful about Elton John performing in a concert to raise money for a US presidential candidate," and the 1981 FEC advisory opinion Wiehl cited did not state, as she claimed, that "you couldn't volunteer any time if you're a foreign national."
Responding to a March 27 "Inside the Beltway" column by The Washington Times' John McCaslin, in which McCaslin wrote that FEC spokesman Bob Biersack "said he doesn't know whether the Elton John performance would be considered unlawful by FEC standards," the Clinton campaign's Fact Hub website quoted Biersack as saying: "I did not intend to convey in my conversation with the Washington Times reporter that there is anything unlawful about Elton John performing in a concert to raise money for a US presidential candidate. The Advisory Opinion 2004-26 is clear in the circumstances of the request that foreign nationals may volunteer and may even solicit contributions from non-foreign nationals, provided they are not soliciting other foreign nationals." The Clinton campaign posted Biersack's remarks before Kelly and Wiehl discussed the concert's legality, but neither one mentioned Biersack's follow-up as reported by the Clinton campaign.
Moreover, contrary to Wiehl's assertion that the 1981 advisory opinion stated that "you couldn't volunteer any time if you're a foreign national," that FEC opinion prohibited a foreign national -- an artist -- from donating his services to produce something tangible -- a painting that person created -- to a campaign; it did not prohibit donating a service alone. As Wiehl noted, the FEC found, in a 1987 opinion, that a foreign national could "provide uncompensated volunteer services to a presidential campaign."

Well, what Elton John is saying is -- and the Clinton campaign is saying, "Wait, he's not contributing funds. He's just contributing his time and his services and all of that, so he should be able to do that." All right. So, then there was this big brouhaha that's been kind of percolating the last couple of days about this.
KELLY: Well, because you can't contribute directly or indirectly.
WIEHL: Right, or indirectly. So, is that indirect contribution by saying, "I'm going to come and I'm going to give you all this money --
KELLY: Did he say --
WIEHL: -- I'm not giving you money, but I'm going to give you all of this attention and all these people are going to come and they're spending $125 per ticket at Radio City Music Hall" --
KELLY: At least, they're going for 700 bucks online right now.

But back to the matter at hand, the story in Washington Times doesn't say that this is illegal just unusual. If a complaint is poused to the FEC then it will decide. Hill's fact checker indicates a different statement that appears about the same time the Fox show came on. This thread is about an incident that happened yesterday, again about the same time the FEC commented to Clinton's campaign. The FEC has not released on its website anything relating to this question, just the reporting by Clinotn's campaign and Wash times.
Barking at Fox for this is like saying that Bagdad Bob McDermott's visit to cuddle with Saddam Hussein (not his middle name mind you) was 'just about the children'. Both stories are not clearly resolved, as yet.
The Election Commission will have to decide whether or not it violates the law, and maybe they have already. It seems that this mess could have been avoided if only EJ was paid fair market value from the Clinton campaign, (I hear chinese dishwashers are wonderful fans of Elton, so that should present no problems for her coffers). Sorry - I'm having a crawfish boil and will have the driveway lights, spot lights, house lights and party lights going full blaze. What the hell happened to him? If there was an award for the artist who has taken the steepest plunge from the top, I'd say that Elton John wins.
I know younger people who think he's terrific. They paid a fortune to see him recently and did all old material. They weren't familiar with it. A lot of it was from Tumbleweed. They couldn't stand it. They wanted to hear dirges from The Lion King.

My wife and I were not home during that hour Saturday night. Proud Imbecile. We sell merchandise at a flea market on the weekends, and were driving home at that time. But instead of participating in one-shot events liake the one on Saturday noght, I prefer to do things on a daily basis to save Mother Earth:
1. I drive a 4-cylinder vehicle that gets 25 MPG (I'd like to drive something more efficient, but my wife is disabled and we need something that will transport her mobility scooter. The vehivle we bought - a Honda Element - had the most room inside and the highest mileage of all the vehicles we looked at.)
2. We purposely bought a house less than ten miles from my office so i use less gas to commute. And combine shopping trips to minimize gas use the rest of the time.
3. We bought a home that's just big enough for us. We don't have to be concerned with heating and cooling a huge home with cathedral ceilings and a Great Room designed to impress others; our two-bedroom rancher has 1,000 square feet, and that's all we need.
4. We do everything we can to conserve energy, from using a programmable thermostat to making sure lights are not kept on needlessly.
In short, I think we do more than our share on a daily basis to conserve energy and save Mother Earth? Can you make the same statement, Proud For No Good Reason? I don't think so...
If we elect that McCain kid as our next president, with his fondness for bomb, bomb bombing, we might find ourselves back in the stone age in no time.

Why is it that the media is not picking up on the credentials of valor that McCain supposedly earned? One of his valor awards the DFC (Distinguished Flying Cross) is awarded to any personwho, while serving in any capacity with the Armed Forces,distinguishes himself or herself by heroism or extraordinary achievement while participating in aerial flight. The performance of the act of heroism must be evidenced by voluntary action above and beyond the call of duty. I have not been able to find any mention of the citation that should accompany this honor. My father received this award,DSC in WWI there should be a citation with it. If you search the files there is none to be found. Why is he given a free pass on this?
