I just heard Rush launch this next salvo: Getting the gun crowd up in arms because, as Rush put it, Sotomayor wrote a decision that said owning a gun is not a fundamental right. So since Rush said it, I decided to find out the truth.

The decision is unsigned so nobody knows which of the three judges wrote it. http://www.politechbot.com/docs/us.vs.sanchez-villar.2nd.circuit.txt An illegal alien was busted for cocaine and had a gun. Good one, Rush! The judge did not say what Rush said she did, but cited a precedent case that did say it, where a group of Irishmen was caught smuggling assault weapons to the IRA. Another score, Rushie! I like your friends. That court found that the State of NY could ban all weapons except those for which the owner had a license, and therefore was not a "fundamental" right. And that case was in 1983. There has been more clarification of state rights to limit weapons ownership since then. http://www.cs.cmu.edu/afs/cs/usr/wbardwel/public/nfalist/us_v_toner.txt

So watch the BS come, and be prepared to counter it with facts.
