UPDATED: Fox Completely Fabricates Report That TSA Will Screen Passengers' DNA

A Fox & Friends segment reported that the Transportation Security Administration will begin testing airline passengers' DNA at airports. In reality, the Department of Homeland Security is planning to test a portable DNA screener for use in certain immigration cases; the TSA is not testing the device and says it has no plans to test DNA.

Napolitano: Test "Reveals The Most Intimate Information About Your Genetic Makeup." From Fox & Friends:

GRETCHEN CARLSON (co-host): Well, the TSA could be taking the security check at the airport to a whole new level. This summer, the Department of Homeland Security may test new technology that would allow them to test passengers' DNA at the security line.

BRIAN KILMEADE (co-host): The government says it will be used to stop human trafficking and illegal immigration, but is this going too far? Judge Napolitano says, "No, keep going."

KILMEADE: Freedom Watch [inaudible]

ANDREW NAPOLITANO (Fox Business host): What a way to start this segment.

KILMEADE: I'm just jumping ahead, Judge. I know how you feel. But you're the host of Freedom Watch, you know, on the Fox Business Channel. So first up, this really offends you.

NAPOLITANO: Well, it offends the Constitution. Look, you own your body if you own anything. If the government wants the contents of your body -- this is very basic black-letter law -- it has to go to a judge and explains why it wants the contents of your body and that somewhere in your body is the evidence of a crime, like you swallowed some controlled, dangerous substance to prevent the police from grabbing it.

Short of that, they can't take it. It seems inoffensive. It's a Q-tip swab on the inside of your mouth. It takes just a couple of seconds. But it reveals the most intimate information about your genetic makeup that the government has no right to have.

Look at how we've gone. We've gone from a magnetometer, to a pornographic image -- graphic image of private parts, to the grope and feel, to the government getting the contents of the inside of your body. All of it unlawful. All of it without a search warrant. Where will they go next? [Fox & Friends, 3/1/11]

CARLSON: All right, so is there any legitimacy to what the government claims that they're trying to do here, which is --

NAPOLITANO: No.

CARLSON: OK.

CARLSON: Which is to build a database of terrorists and -- sorry, I'm going to ask the obvious question -- profile, instead of swabbing everyone with a Q-tip?

NAPOLITANO: Actually, the government claims that they are looking for people who may be involved in illegal immigration and human trafficking. That's compelling a person to enter the country against their will for some illegal purpose. That has nothing to do with safety on airplanes. [Fox & Friends, 3/1/11]

Kilmeade: "Who Are These People Looking To Control People? I Think They're Just Trying To Stop Illegal Human Trafficking." From Fox & Friends:

NAPOLITANO: This doesn't keep anybody safe. This just feeds the government's voracious appetite to control people, to invade their privacy, and to learn more about them.

KILMEADE: But who are these people looking to control people? I think they're just trying to stop illegal human trafficking.

NAPOLITANO: It's a mentality in the government that says, "We have the power to do this, so let's just keep pushing the envelope." As I've indicated to you, from a metal detector to the contents of your body, all without judicial approval and all without a vote from Congress. These are bureaucrats making these decisions. These are not our elected representatives. [Fox & Friends, 3/1/11]

Reality: TSA Won't Use DNA Screener; DHS Already Offers "Absolutely Voluntary" DNA Tests In Refugee Cases

TSA: DHS' Citizenship And Immigration Services "Already Uses DNA Testing In Some Cases To Establish Familial Relationships In Refugee Processing." From a February 26 post on the TSA Blog:

The DHS Science and Technology Directorate (S&T) is doing preliminary testing with U.S. Citizenship and Immigration Services (USCIS) who already uses DNA testing in some cases to establish familial relationships in refugee processing. [The TSA Blog, 2/26/11]

TSA Is Not Testing Scanner, Has No Plans To Use DNA Testing. From The TSA Blog:

DHS S&T expects to receive a prototype DNA analyzer device this summer to conduct a preliminary evaluation of whether this kind of technology could be considered for future use. At this time, there are no DHS customers, nor is there a timeline for deployment, for this kind of technology - this is a simply a preliminary test of how the technology performs.

Again, TSA is not testing and has no plans to use any technology capable of testing DNA. [The TSA Blog, 2/26/11]

USCIS Field Manual: "DNA Testing Is Absolutely Voluntary." From the USCIS Adjudicator's Field Manual, which "comprehensively details USCIS policies and procedures for adjudicating applications and petitions":

(B) Authority to Require Parentage Testing . A petitioner must establish eligibility for a requested immigration benefit. An application or petition must be filed with any initial evidence required by regulation or by the form instructions. Any evidence submitted is considered part of the relating petition or application and may establish eligibility. 8 CFR 103.2(b)(1).

Although a director may require blood parentage testing, he or she has no statutory or regulatory authority to require DNA testing. However, when initial and secondary forms of evidence have proven inconclusive and blood parentage testing does not clearly establish the claimed parental relationship, field offices may have no alternative to suggesting DNA testing as a means of establishing the relationship. The petitioner has the burden of proof when the evidence submitted has not satisfied his evidentiary threshold and the USCIS would otherwise deny the petition without more conclusive evidence such as that which DNA testing could provide. In such cases, field offices should inform the petitioner that:

  • DNA testing is absolutely voluntary;
  • The costs of DNA testing and related expenses (such as doctor's fees and the cost of transmitting testing materials and blood samples) must be borne exclusively by the petitioner; and
  • Submitting to DNA testing is in no way a guarantee of the approval of the petition. [USCIS Adjudicator's Field Manual, accessed 3/3/11, emphasis added]

DHS Official: "Analyzer Avoids Sampling DNA That Could Identify Genetic Problems." From a February 24 article in NextGov, a National Journal Group publication that "provides coverage and commentary on the management of information technology in the federal government":

As a precaution to protect privacy, the analyzer avoids sampling DNA that could identify genetic problems, [Christopher Miles, biometrics program manager in the DHS Office of Science and Technology,] said. For years, privacy advocates have worried that DNA test results could be used to deny people employment, insurance or entry to the country. [NextGov, 2/24/11]

DHS Official: "We Have Privacy Officers And Civil Rights And Civil Liberties Officers Who Are Working Through" Privacy And Civil Liberties Concerns. From NextGov:

Although DNA analysis speeds identification of people, it raises concerns about privacy and civil liberties, Miles conceded. "We have privacy officers and civil rights and civil liberties officers who are working through all of those questions." [NextGov, 2/24/11]

        Never mind the DNA. Are media matters' progressives already OK with having naked pictures taken of us individual citizens through our clothes or being felt up at the airport prior to taking advantage of our freedom to travel? It looks like Glenn Beck was right about the Overton Window, at least in this case. We moved from metal detectors to x-raying our carry ons, to taking off our shoes to naked pictures and being felt up. It would not surprise me at all if they do start taking our DNA. And media matters would probably say that is not really a violation of our right to privacy or anything else. Imagine what we're going to have to do if a terrorist hides a bomb in his/hir colon. Bend over everybody. Check those cavities.

          I'm a conservative. I have had to go through hand patdowns for several years because I have an internal medical device. Is it fun? No, but if I want to fly, I endure. As for the "naked pictures," please! It's no more revealing than an x-ray. My objection to them is the unnecessary exposure to radiation, not worried about them seeing outlines of my body.

          BTW, most of these TSA laws were enacted under the previous administration. Did they bother you then?

          You do know that Beck's book was a work of fiction, right? A work of fiction that he didn't even write. It was ghostwritten. Get a clue, hon.

            FYI - You'll get more radiation from the flight itself than from the body scan. If you're that worried about the radiation, then you shouldn't fly.

            Is saying "Please" a rhetorical device that's supposed to have meaning or discredit the object of your scorn. Or is it just a personality disorder that causes you to say that? CBS and ABC won't show the pictures without blocking out the breasts and the crotch area. That indicates more revealing than an xray. And it's a question of too far. I didn't like taking shoes off etc. under bush, but the xmas bomber brought this invasion of privacy on. But it's not Bush or Obama I'm against. It's progressivsm. Example: In the patriot act under Bush, wire tapping was allowed of U.S. citizens without a warrant. WRONG. BUSH SHOULD NOT HAVE DONE THAT. OBAMA was correct to vote no. But, Here's the rub. That civil liberty's invasion was touted by Democrats as being an invasion of privacy. So, the Democrats get elected to control all three branches of government. How many of them got up to remove the wire tap provision of U.S. citizens without a warrant. ABSOLUTELY NONE that I know of. Maybe Kucinich, but I only say that cuz I think he's an honest guy and concerned about certain things I am. I have no evidence he actually suggested pulling that provision in the Patriot act. Conclusion: "We don't want the right wing nut jobs to have the option to invade your privacy, but us good left wing pinkos, yeah, we are ok with invading your privacy, because, as we all know, we are the good guys." If the left was so concerned about that kind of warrantless info gathering on U.S. citizens, why didn't they end the wiretapping when the Patriot Act went up for a vote? Because, now that they are in control, wire tapping was just fine. It don't make sense unless you think of both the Republicans and Democrats as two sides of the same progressive coin.

            NO, NOT BECKS OVERTON WINDOW. Joseph Overton's Overton Window. Read about it. Beck wrote a book motivated by the overton window. But the book is not worth reading. Partly I'm sure due to the fact Beck is an intelligent nurd trying to write a love story, which was part of the plot. That had little chance of turning out well from the start. Beck's fiction isn't worth the time. At least that one wasn't. But as far as the Overton Window is concerned, I think it's a real thing. President Obama himself acknowleded that thats what is in play. He said, "In the beginning it was about Widows and Orphans." He was talking about public assistance. "Now, it's about almost everybody." Which is exactly what the Overton Window predicts. I saw him say that, as if it was a good thing. That's where the President and I, and a lot of other individual freedom loving people differ. Anyway, sorry you thought I was talking about Beck's book "The Overton Window". I was talking about the political theory (that's what it's called on Wikepedia, a theory or philosophy). Anyway, I think it holds up. Don't you?

            I just can't believe progressives are so willing to accept this invasion of freeedom and privacy. Yes, there are other ways to travel, but I have the government now nudging my choice. Have naked pictures of you on file, or take the bus. This is progessive thinking? Is it any wonder freedome and liberty lovers aren't progressive? "Sunstein, please decide for me, do I want to get felt up and go by plane, or do I want to walk. Sunstein I need you." Only progressives can call themselves freethinkers, and they do.         Oh please, do you realize how much money all this "security" is already costing us. Never mind the price of all those machines. Calculate how many americans have to waste an hour or two extra a day to be at the airport early. Say each one is making 25 bucks an hour. Now all you have to do is find out how many Americans fly in the U.S. everyday. I don't know what that number is, but say it's 1 million, which is probably a low figure. That's 25 million a day. And they'll pay for the DNA tests by printing money, causing inflation, and reducing the typical person's wealth. And, they will come up with machines that do DNA faster and cheaper. It's control they want, and it's control they're getting. And we are losing our individual rights and freedoms to the gummint. I don't like it.

            Most of these comments have nothing to do with what I said, which is that basically the terrorists won. The cost of using airlines has increased dramatically, not just because of the machines, security measures, and TandA people we have to hire to take pictures and perform patdowns, but because of all the extra time people must waste getting to the airport 1-2 hours earlier than they had to before 9/11. If you do not see that as an economic cost, then you just may be a useful idiot.

            I mean secureity enacted by any administration that goes way too far in invading our right to privacy and our freedom to move about. Bush was a progressive, although slower moving than President Obama. It's not political parties that matter to me, it's freedom and liberty and the loss of those things, that matter to me. Bush's idea to do TARP and perform bail outs was wrong. He was neglecting the free markets to save them (hia words). That is wrong. He allowed the debt to increase dramatically. At the time, I was saying, the Republicans are spending money faster than drunken democrat sailors in a cathouse. I thought no one could outdo those Repulblicans at squandering the country's wealth, which is why I voted for Obama. Big mistake there. But McCain was a mild progressive also. Didn't have much reason to vote for him. A brave hero, but bad policy. But people including Hannity have lied too much about him too. When the news stopped making sense (I thought President Obama was going to chase down some corruption, not just transform it), I started reading more. I watch some fox, some msnbc, and mostly I read books. Newspapers say nothing. Same with the Sunday morning shows I used to watch. Cokie Roberts, not deep enough. George Will, if he has something to say, he doesn't get a chance. Last thing I heard him say was the Egyptian uprising was spontaneous. Wrong. Don't have to look too far to see that.

            Anyway, security under Bush was metal detectors, xray baggage, and taking off shoes, and whatever else you can come up with. That was bad, yes, but naked pictures and pat downs. I don't think that's good for liberty, freedom, privacy, or DEFEATING TERRORISM. By doing that stuff, they already have a win. More wins later.

        That's funny, I just got an email forwarded to me the other day about the "Obama national ID card". There were several comments in the letter about how much Obama's America was beginning to resemble Nazi Germany, how much more identity theft would be committed with this single, standardized ID card that we would all be forced to carry.

        The email had been copied to several people, and a few replied in full agreement that we were being led toward a socialistNaziCommie state by Obama.

        Of course, the law linked to was passed in 2005 as part of the Bush/Cheney Homeland Security deal, and was mostly about accepting IDs for federal purposes. John McCain supported it, Barack Obama opposed it.

        So I hit "reply all wingnuts" with this info, politely letting them know that they were calling Republicans Nazis.

        Their opinion of the law, judging by the responses that followed, changed quite a bit depending on who was behind it.

Right now, you can say it's the Democratic administration and the Democratic congress (Dems were in charge when the naked airport pictures and the feel-up jobs were introduced). Pay attention.         They not only don't take into account the cost involved "if" the TSA was going to do this, they're also not taking into account the time involved. If this were to actually come about flights would be delayed days and days!! They're just throwing the "fear" out there to smear the government (under Obama) once again. Anyone that believes these morons needs a DNA test to determine whether they are actually humans.

        TSA: DHS' Citizenship And Immigration Services "Already Uses DNA Testing In Some Cases To Establish Familial Relationships In Refugee Processing." From a February 26 post on the TSA Blog:
