BRIAN KILMEADE (HOST): Martha, one of the quotes is, “If we had confidence he didn't commit a crime, we would have said so. We don't take a position on whether he did commit a crime,” because they can't charge him. So that's hardly an exoneration.
MARTHA MACCALLUM (FOX NEWS ANCHOR): Absolutely. And, you know, I knew as soon as we heard that sentence, you were going to see that on the bottom of every single cable news TV screen and that's what you're seeing because that's the big take away in terms of whether or not Congress will see this as, you know, sort of bread crumbs that have been left for them, you know it's completely open, you can investigate -- continue to investigate, continue to subpoena if you want. He's saying today if we had confidence that the president clearly did not commit a crime, we would have said so.
But, I'll go back to the point I made earlier, one, it is not their job to say we couldn't exonerate him. Their job was to determine whether or not there was a criminal charge that should be made and what -- and that's the only determination that is required of them. Everybody from Trey Gowdy to Andy McCarthy will tell you the exact same thing -- it doesn't matter what they think about whether or not they could exonerate him. What matters is whether or not they could charge him. Also interesting to think about, the fact that Robert Mueller took pains at the beginning of his discussion to say that although there were 20 something Russians indicted in this case, they are innocent unless proven guilty. He did not say the same thing about the president of the United States.
