HARRIS FAULKNER (HOST): I want to use this as a backdrop. Not only do we have tourists here but we recently found out in the last day or so that we have 58,000 known criminals who have crossed our border illegally. Not that there would be any connection naturally with this, but it makes the work harder for NYPD because they're already dealing with rampant crime uptick from those individuals who broke our first law coming here illegally.

DARRIN PORCHER (GUEST): Yeah, absolutely correct. You know, I'm glad that the mayor is switching his calculus and looking to deporting these people that have been arrested or have prior arrests, because the migrant process — the migrant crisis in New York — has dilapidated the quality of life in not just Manhattan, but all the five burrows. So, hopefully, we can get something done with the new administration to rid us of the tyranny that this migrant crisis has bestowed upon our great city of New York.

FAULKNER: Well, and just in terms of fighting crime it makes it hard. Because these aren't just people who come here. They intend to live the life that they had before they had crossed the border, and that was a life of crime. I mean, 58,000 people on the streets of Manhattan or in the five burrows is a lot of people to keep up with when you're trying to lock down a crime scene that may or may not have anything to do with them, but they're roaming. They are always there. So you've got to kind of vet that situation and protect the tree and everything else and the millions of people who will be coming in and moving about the city later tonight. I want to bring in Leo Terrell, attorney and Fox News contributor, and have both Darrin and Leo with me on this one. We're about to hear an update now from NYPD. Leo, what things are we looking for when you hear “random act," is not something that they even suspect at this point? Talk to me about the law.

LEO TERRELL (CONTRIBUTOR): I'm looking at planning and premeditation in the sense that this CEO was gunned down. Darrin talked about the fact that this guy was there prior to the CEO arriving. I'm also looking at the idea of whether or not he had partners involved. He had a bicycle. He had equipment. He had things that he utilized to execute this individual. So I'm looking at whether or not the police department — and I'm sure the district attorney is collecting this information. You raised one another point, Harris. You talk about the grid, which Darrin talked about. A lot of cities have this grid where there's cooperation. But New York City is a sanctuary city. Question mark, this guy had a mask on. Question mark as far as the cooperation that's going to take place involving this individual. We don't know his ethnicity, we don't know his legal status. There's a lot of other questions that the prosecution and district attorney is going to have to feather out.
