ANDREW MCCARTHY (NATIONAL REVIEW): What's really interesting about this is the case against [Michael] Cohen, the investigation that Cohen is involved in, is a standard law enforcement investigation, right? The president, who also is dealing with an investigation, is not dealing with a standard law enforcement investigation. He's never going to be indicted. His only concern is impeachment; it's not a criminal investigation. The very interesting thing about this is impeachment is a political remedy, it's not a legal remedy. So the way you have to fight it, because you never have an impeachment unless the public so supported it that 2/3 of the Senate would support removing someone, right? You have to fight that in the court of public opinion. So there are positions you take when your concern is impeachment that you would never take in a legal situation because anything you say, if your concern is prosecutors, anything you say can get used against you in court. So if you give a version of events and then down the line new evidence emerges that blows up your version of events, they can use that against you in court. The president's not worried about that. The president's worried about impeachment, and that means he's got to fight this out in public, not in the courtroom.
