On the September 28 broadcast of 630 KHOW-AM's The Caplis & Silverman Show, co-host Dan Caplis stated, “What we do on this show is, we do our research; and we put together analytical, intellectual, factual, historical arguments; and we go out and we make wrong things right.” Caplis was responding to the Boulder Daily Camera's September 28 editorial, which criticized Caplis and the show by name for, as editorial page editor Clint Talbott wrote, “not unpredictably, dwell[ing] at length on the latest Boulder High hubbub” concerning a student-led protest over the Pledge of Allegiance. Contrary to his claim, Colorado Media Matters has documented numerous instances in which Caplis, co-host Craig Silverman, and/or their guests ignored or distorted facts in making arguments on the show.

As Talbott wrote in his Daily Camera editorial, “Thursday morning, about 50 Boulder High students gathered in the school courtyard and recited an 'alternative' to the Pledge of Allegiance, one that extols constitutional rights, 'diversity' and the planet. The demonstration was organized by the Student Worker club, whose members object to the inclusion of the words 'under God' in the Pledge of Allegiance.” The editorial later stated:

The “Caplis & Silverman” show has, not unpredictably, dwelled at length on the latest Boulder High hubbub. Dan Caplis, the more conservative of the two, on Wednesday called [club president Emma] Martens “goofy,” “misguided” and “over-sensitive.”

“She wants attention; she wants publicity; she's taken this extreme position to get it,” Caplis said. “The existence of this nation is rooted in a belief in God.”

If Caplis were more thoughtful, he might feel embarrassed. He is, after all, a 50-year-old attorney who has argued before the Colorado Supreme Court and enjoys a privileged position in a media bully pulpit. Yet here he is, hurling sophomoric insults at a 17-year-old girl. And here he is, a man who's spent decades chasing microphones, lambasting a child for wanting “publicity.”

As Colorado Media Matters pointed out, appearing as a guest on the September 28 broadcast of Fox News' The O'Reilly Factor, Caplis called the Boulder High students “these little teen secular-progressives trying to go in and force their will on the majority” and stated that principal Bud Jenkins “has to serve” a “far-left master” at the Boulder Valley School District.

CAPLIS: Let me deconstruct this for a second. “If [I] were more thoughtful, [I] might feel embarrassed.” I'm not going to dignify that. That's playground stuff. He then goes on to say, “50-year-old attorney argued before the Colorado Supreme Court.” Actually, I've been privileged to argue a lot of important cases, but not yet before the Colorado Supreme Court, but I appreciate, the, you know, reference. And then he goes on to say, “enjoys a privileged position in a media bully pulpit.” I do enjoy a privileged position, which I'm grateful for every day, but it's hardly a bully pulpit. What Clint's doing here is a bully pulpit. No intellectual argument, instead personal shots. What we do on this show is, we do our research; and we put together analytical, intellectual, factual, historical arguments; and we go out and we make wrong things right.

Contrary to Caplis' claim that his show “put[s] together analytical, intellectual, factual, historical arguments” to “make wrong things right,” Colorado Media Matters has documented the following instances, among others, in which Caplis and/or Silverman misrepresented facts or spread misinformation in making an argument:

• Caplis repeated old misinformation about Edwards' Christopher Reeve remark
• Discussing charges against GOP Sen. Craig, Caplis falsely claimed that Idaho has elected only one Democratic senator
• Caplis claimed birth control “fails at an alarmingly high rate” despite stats showing its efficacy
• Caplis, Silverman falsely claimed Boulder proposal would allow illegal immigrants to serve in local government
• Caplis ignored his previous remarks, widespread reporting to suggest Obama's campaign itself is “stirring up” questions about being “black enough”
• Caplis, Boyles, and James distorted state official's remarks on tuition for children of illegal immigrants
• Caplis again misled about purported pre-war link between Iraq and Al Qaeda
• Caplis misled on 9-11 Commission report
• Calling conservative talk radio “true” and “sensible,” Caplis dubiously claimed, "[M]ost of America is conservative"
• "[Y]ou can't have your own facts": Caplis falsely claimed Rep. Cerbo opposed memorializing U.S. troops killed in Iraq
• “I love gay people”: Caplis falsely claimed that “vast majority of people” agree with him that homosexuality is “immoral”
