ALAN DERSHOWITZ (NEWSMAX CONTRIBUTOR): The Constitution specifically prohibits any religious test. I think the 14th Amendment specifically prohibits any racial or gender test. I do not think the president has the right to engage in identity politics and say, I'm not going to necessarily pick the most qualified person, but the most qualified Black woman. Now, there are enormous numbers of qualified Black women and others out there. But for the president, to set up a quota system this way is just un-American. It's wrong.
