GREGG JARRETT (GUEST): I mean, the attorney general is not allowed to appoint David Weiss as special counsel. Under federal regulations -- and I have them right here in front of me, CFR 600.3 -- the attorney general can only appoint somebody, quote, "outside the government." I'm looking at it. It's in black and white.
Why? Because Weiss is conflicted, he's accused, as you point out Sean, by IRS whistleblowers of political interference to protect the Bidens, allowing the statute of limitations to expire on the most serious felonies, tipping off Hunter's lawyers, scuttling planned searches, foreclosing questions about Joe's involvement, and, of course, negotiating this absurd plea deal, and a dozen other acts of preferential treatment. So Weiss is the absolute last person on earth who should be named special counsel.
SEAN HANNITY (HOST): Wait, are you saying -- so, what Garland did today is not allowed by law?
JARRETT: It's lawless. Yes, absolutely. 28 CFR 600.3. The attorney general must appoint someone, quote, "outside the U.S. government." Weiss is not only in the U.S. government, but, you know, he's part of the Biden administration's Department of Justice and reports directly to Merrick Garland.
So, you know, what Merrick Garland is doing is, he is defying the federal regulations, which have been codified by Congress into law. He's acting in a brazenly lawless way.
