MARIA BARTIROMO (ANCHOR): What do you think he was trying to do yesterday? 

ALAN DERSHOWITZ (FOX NEWS CONTRIBUTOR): You know, I have no idea. The obvious effect is to help the Democrats push for impeachment. It's just wrong for a special counsel to say what he said; 'he had the evidence that he was innocent he would have said so.' Imagine if Comey had said that about Hillary Clinton. He said something close, remember, he was widely criticized for that. The job of prosecutor is simply to decide whether there's sufficient evidence to go forward to prosecute. If, as Mueller says, there never could have been a prosecution of the president under the Constitution, then why was he appointed? They should've appointed a commission of inquiry, an investigatory, non-partisan, expert commission like 9/11, make recommendations going forward about Russian involvement in the election. But to appoint a prosecutor who can't prosecute, so that he can then make statements that are not based on the evidence -- remember, a prosecutor hears only one side of the case. 

BARTIROMO: Yeah.

DERSHOWITZ: He doesn't hear the defense side, doesn't hear cross-examination. So he couldn't conclude that the president committed a crime, even if he saw that evidence. So I think what he said yesterday was absolutely irresponsible.
