ABC's Dan Abrams Dismantles Conservatives' Claims That Clinton Was “Grossly Negligent” With Her Emails

Abrams: To Prosecute, “You Need A Level Of Intentional, Willful Conduct That Simply Didn't Exist Here”

GEORGE STEPHANOPOULOS (HOST): Let's begin with the law, Dan. That standard that the FBI director said. “No reasonable prosecutor would bring charges.” He seems to be suggesting that legally this wasn't a close call.

DAN ABRAMS: Right, so on the one hand, I think that for a long time, the Clinton supporters had been minimizing the significance of what happened here. And I think James Comey made that quite clear in laying out a sort of moral indictment of Hillary Clinton.

STEPHANOPOULOS: Scathing.

ABRAMS: She broke rules, she violated norms. But that's not necessarily criminal. And then he laid out at the end the criminal standard. We're talking about espionage law here. People are saying, “Oh, gross negligence, that's the Espionage Act.” And basically what James Comey is saying is you want to prosecute someone, either under this misdemeanor or this felony of the Espionage Act, you need a level of intentional, willful conduct that simply didn't exist here.
