DANA PERINO (CO-ANCHOR): Can I ask you though, so the White House was emphatic. They said again yesterday, he is never coming back. But when you say he's not in custody, is he free to walk around, he's free to go?
ANDY MCCARTHY (LEGAL CONTRIBUTOR): We don't know. You know, what we don't know, Dana, is was this whole thing with the Senator Van Hollen last week, was that staged? You know did they let him out for a few hours and have a minder there and once Van Hollen was gone, they put him back in the prison? Or is he free to walk the streets? We don't know.
PERINO: Okay, Tom Homan also, I'm not going to play the sound because, just for time, I just want to ask you this one last thing. He says they stand by the fact that they did the right thing here. What you're suggesting is if they want an off ramp, it exists in the law that they could find it.
MCCARTHY: It always has, Dana. They don't want off ramps. What I'm worried about is they actually want to use this as a demonstration that the court can't control them and they don't have to honor due process. That's the worrisome thing about this.
