Kurtz falsely described Gray's appearances on Fox

In his July 11 “Media Notes” column, Washington Post staff writer Howard Kurtz falsely claimed that Fox News contributor and Committee for Justice founder C. Boyden Gray “in one case was interviewed on Fox without a liberal counterpart and mistakenly labeled a network 'analyst.'” In fact, Fox News identified Gray as a “Supreme Court analyst” on at least two occasions, and he has appeared on the channel at least nine times without a liberal counterpart since Supreme Court Justice Sandra Day O'Connor resigned the morning of July 1.

Media Matters for America has previously noted the conflict between Gray's purported role as Fox News “Supreme Court analyst” and his chairmanship of the Committee for Justice, a conservative group created to push for confirmation of President Bush's judicial nominees. Media Matters has also noted that Gray has been interviewed without a liberal counterpart on several occasions.

A Media Matters review of Fox News found that Gray made at least two appearances on Fox as a “Supreme Court analyst,” during the 11 a.m. and 2 p.m. ET hours of Fox News Live on July 1. Gray was also interviewed at least nine times without a liberal counterpart since July 1. He was the sole subject of interviews on the following programs:

  • Fox News Live, July 1, 11 a.m., 12 p.m., and 2 p.m. hours.
  • Dayside with Linda Vester, July 1.
  • Fox & Friends, July 5, 7 a.m. hour.
  • The Big Story with John Gibson, July 8.
  • Hannity & Colmes, July 8.

Gray also participated in interviews on Fox News Live on July 1 and on Fox News Live on July 4, opposite George Washington University law professor Jonathan Turley and Fox News Supreme Court analyst Tim O'Brien, respectively, neither of whom can be characterized as “liberal counterparts.”
