During the August 22 broadcast of Newsradio 850 KOA's The Gunny Bob Show, host “Gunny” Bob Newman asserted that, in her August 17 ruling that the Bush administration's warrantless eavesdropping program is illegal and unconstitutional, Judge Anna Diggs Taylor “sided with Al Qaeda, did exactly what Al Qaeda wanted him [sic] to do.” Newman asked listeners, “Are you happy, as Al Qaeda is, with that federal judge's ruling?”

While Newman identified Taylor as a man, the Michigan Supreme Court Historical Society identifies Taylor as the first black woman judge to be appointed to the U.S. District Court for the Eastern District of Michigan.

NEWMAN: A federal judge just ruled that, according to him, at least, the National Security Agency has to have permission from a judge to monitor terrorist communication here in the United States. Does the Constitution anywhere say that the government must have permission from a judge to defend the nation from attack? It's been appealed, of course. And some of the people that the NSA was listening to, with their eavesdropping program, were here in the United States illegally. It's all tied in together. Was this what our founding fathers intended -- this ludicrous decision, which is akin to saying that the Constitution is a suicide pact? Are you happy, as Al Qaeda is, with that federal judge's ruling? That judge sided with Al Qaeda, did exactly what Al Qaeda wanted him [sic] to do.
